Terms and Conditions of Hire

1. General

The acceptance of our, David Groom Sound Limited (otherwise referred to as the Company), quotation shall be deemed to include the acceptance of the Company's Terms and Conditions. Unless agreed otherwise, written confirmation of the booking is required. In some instances a deposit may be requested.

2. Availability

All equipment offered in the quotation will be subject to availability at the time of your event. We reserve the right to substitute with a suitable alternative.

3. Extra Costs

In the event of work being suspended, access to site being blocked, marquees not being erected to programme, arenas not being marked out, or failure to provide adequate information and or instructions at any stage the price, at the discretion of the company, may be increased to cover additional expenditure incurred by the company.

4. Hirer’s Responsibility

The hirer shall provide the Company with a detailed plan of the site showing where he/she requires sound coverage and the Commentary Units to be located and or equipment set up, or alternatively have a representative on the site for that purpose. Otherwise the Company will set up equipment where it thinks most suitable and, in the event that the Hirer wishes the equipment be repositioned, any costs incurred by the Company for this work will be charged to the Hirer.

5. Site Conditions

In adverse weather or ground conditions it is the responsibility of the Hirer to provide necessary towing vehicles to assist with moving our equipment on and off site. Any expenses incurred by the Company will be passed on to the Hirer. The Company will not be responsible for any making good or repair of damage to the site howsoever caused.

6. Ownership

All equipment remains the property of David Groom Sound Limited It is the responsibility of the hirer to keep the hired equipment in a safe place and return it to a safe place in the same condition as it was collected.

The equipment remains the Company's property until paid for in full.

In the event of non payment, the Company reserves the right to enter the Customer's property or site to recover hired equipment.

7. Delivery and set up

Delivery times and set up times are given as an estimate only and will not be legally binding. No direct or indirect liability will be accepted as a result of late delivery.

8. Insurance

Insurance of all equipment is the Hirer’s responsibility.

The Hirer shall indemnify the Company against all damage to or loss of the equipment once the equipment has been delivered to the hirer and then until the equipment is collected or once the hirer has collected the equipment and then until returned.

9. Liability

All equipment hired should be installed and operated by a competent person. The Company accept NO responsibility whatsoever for damage or injury to persons or property whilst the equipment is on hire.

The Company will not be under any Liability whatever, however arising to the Hirer, for any consequences of equipment failure, malfunction or defect. In particular the Owner will not be liable for consequential or pure economic loss in any event.

10. Copyright

The Hirer must be responsible for obtaining the appropriate licences for the playing of any recorded music on the Company's equipment.

11. Noise Abatement

The hirer is responsible for complying with all relevant laws, bylaws and regulations applicable and incidental to the use of the equipment. It is the Hirer’s responsibility to be aware of and adhere to, any restrictions on the venue, with regard the use of PA systems between certain hours, and Sound Levels. The Company will advise on such matters and take the necessary precautions to comply with these restrictions when setting up the equipment.

It is the Hirer's responsibility to ensure that these restrictions are adhered to.

12. Equipment Failure

Should equipment that has been hired develop a fault as a result of normal usage or fair wear and tear, the Company must be informed immediately. If practically possible, arrangements will be made to provide a replacement, or service, at the Company’s expense.”

Unless the Company is informed at the time of breakdown, no refund or allowance can be made from the Hire cost.

13. Cleaning

Commentary Units are supplied in a clean and tidy condition. If returned in a heavily soiled and/or littered condition, we reserve the right to make a cleaning surcharge.

14. Radios

The Company hold a Private Business Radio Suppliers Licence, which is subject to conditions of use.

  • The radio is not to be used to transmit music, broadcast programmes or obscene or offensive language.
  • The radio is not to be used as a Public address system
  • The equipment must only be operated on the power and frequencies and antenna heights specified at the time of hire.
  • Radios must be returned at the end of the Hire period. Radios not returned are considered to be on hire until returned or paid for in full.
  • Radios not returned to the Company within 14 days of an event will be charged for at Full Replacement cost.
  • A refundable security deposit may be asked for to cover the cost of any radios damaged or lost during the hire period.

Radios ordered and or collected will be charged for whether used on not.

15. Cancellations

Cancellation of an event or hire is subject to the following scale of charges.

  • More than 4 weeks notice: no charge
  • More than 3 Days and less than 3 weeks notice: 25% of total price quoted
  • Once equipment has been delivered to site and set up - normally within 3 days of an Event: 75% of the total quoted price
  • Less than 24 hours of the event start time: 100 % is payable

Deposits are non refundable.

Should an event be rescheduled, the abandonment fee may be reduced dependant upon whether the equipment may be left set up, and a visit to site can be avoided. (This normally applies to Point to Point fixtures which can be rescheduled at short notice.)

16. Payment

Payment is strictly cash or cheque with guarantee card upon collection or after installation of equipment. A security deposit may well be required when equipment is collected. The deposit will be refundable on return of the equipment in good order. Proof of identity may be required.

For Show hires: Payment is due in full on the last day of the event, unless prior arrangements have been made. Interest will be charged on all overdue accounts.

17. VAT

All price quoted are exclusive of VAT.

VAT at the current Rate will be added to all Invoices. Installations of Induction hearing loops for the hard of hearing are zero rated
